What's in this personal training agreement

The full text. Words in brackets are filled in from the form above.

  1. 1. The parties. This agreement is between [Client name] (the Client) and [Trainer or business name] (the Trainer) for personal training starting on [Start date].
  2. 2. Sessions. The Client is buying [Package], held at [Where sessions take place] or another place both agree. The Trainer will plan sessions around the Client's goals and fitness and adjust them as needed.
  3. 3. Price and payment. The price is [Package price]. Sessions must be used within [Package expiry], after which unused sessions lapse unless the Trainer agrees to extend them. Package fees are not refundable, except where the Trainer cannot provide the sessions or the law requires a refund.
  4. 4. Health questionnaire. Before the first session the Client will complete the Trainer's health questionnaire, such as a physical activity readiness questionnaire, honestly and in full. The Client will tell the Trainer before any session about a new injury, illness, medication, pregnancy or other change in health.
  5. 5. Medical clearance. The Trainer is not a doctor and does not diagnose or treat medical conditions. If the questionnaire or anything the Client says suggests a concern, the Trainer may ask the Client to get advice from a doctor or other health professional before training starts or continues.
  6. 6. Client declarations. By signing, the Client confirms that: they are 18 or over; the information in their health questionnaire is true and complete; they know of no reason why they should not take part in exercise, other than anything they have told the Trainer in writing; and they will not train under the influence of alcohol or drugs.
  7. 7. Risk. The Client understands that exercise carries a risk of injury, such as strains, sprains and muscle soreness, and in rare cases more serious harm. The Client will follow the Trainer's instructions, work within their own limits, and stop and tell the Trainer straight away if they feel pain, dizziness, chest discomfort or shortness of breath beyond what is expected.
  8. 8. Cancellations and lateness. The Client may cancel or move a session by giving at least [Cancellation notice] of notice. A session cancelled at shorter notice, or missed, counts as used. If the Client is late, the session still ends at the booked time. If the Trainer cancels, the session will be rearranged at no cost.
  9. 9. Results and nutrition. Results depend on many things outside the Trainer's control, so no particular result is promised. Any nutrition guidance is general healthy eating advice, not a medical or clinical diet.
  10. 10. Liability. The Trainer holds professional and public liability insurance. The Trainer is not responsible for injury or loss that does not result from its own negligence. Nothing in this agreement limits liability for death or personal injury caused by negligence, or any other liability that the law does not allow to be limited.
  11. 11. Privacy. The Trainer will keep the Client's health information confidential, use it only to plan safe training, and store it securely in line with data protection law.
  12. 12. Ending the agreement. Either party may end this agreement by written notice. If the Trainer ends it without good reason, it will refund unused sessions. If the Client ends it, unused sessions are dealt with under the price and payment clause.
  13. 13. Governing law. This agreement is governed by the laws of [Governing law], and the courts of that place may hear any dispute about it.
  14. 14. Entire agreement. This document is the whole agreement between the Client and the Trainer about its subject. It replaces anything said or written before it, and any change must be in writing and agreed by both.
  15. Signed by: the Client, the Trainer, each with a signature, printed name and date.

When to use a personal training agreement

Use it before the first session with every new client, whether you train in a gym, a park, a studio or online. It brings together the commercial terms (packages, expiry and cancellations) and the safety paperwork (the health questionnaire, declarations and risk acknowledgement) in one signed document.

What the key clauses do

This is where most personal trainers want certainty, both for the business and for safety.

  • Health questionnaire makes completing your screening form a condition of training and asks the client to keep you updated.
  • Medical clearance says plainly that you are not a doctor and can ask for medical advice before you continue.
  • Client declarations record that the client is 18 or over, the answers are true and they know of no reason not to exercise.
  • Risk explains the kinds of injury exercise can cause and when to stop.
  • Cancellations and lateness protects your diary and makes package expiry clear.

How to adapt it

Attach your own health questionnaire, or link to it, and keep the completed form with the signed agreement. Many trainers use a recognised physical activity readiness questionnaire; check what your insurer and any professional body expect. Keep health questions general and avoid asking for more than you need.

For clients under 18, a parent or guardian should sign and you should check local rules. This template is a starting point, not legal advice, and waiver wording does not work the same everywhere.

Getting it signed

Fill it in, download the PDF and upload it to Sign PDF. The Client and Trainer boxes are placed for you. Send it the moment the client books so it is signed before they walk in.

Questions people ask

Is a health questionnaire the same as a waiver?

No. A questionnaire screens whether someone should get medical advice before exercising. A waiver or risk acknowledgement records that they understand and accept the normal risks. This template covers both.

Can a waiver protect me if I am negligent?

Usually not fully. Many countries do not allow a business to exclude liability for injury caused by its own negligence, which is why the template does not try to and why you need insurance.

Can I train someone under 18 with this?

The declarations say the client is 18 or over. For younger clients, have a parent or guardian sign and check local rules for coaching minors.

Is this template legal advice?

No. It is a plain-English starting point that a small business can adapt. Laws differ between countries and states, so have a lawyer check it before you rely on it for a high-value job or anything regulated.
