Dubai commission and co-broker agreements, signed online
Short answer
In a Dubai sale, the commission between owner and brokerage, or buyer and brokerage, belongs in Form A or Form B in the DLD system. Splits between two brokerages, once recorded on RERA Form I, are agreements between the agencies, and the current DLD brokerage guide does not describe a system step for them. Sign PDF suits co-broker splits and rental fee letters; keep the client commission in the DLD forms.

Client commission stays in Form A and Form B
Bylaw No. 85 of 2006 requires a brokerage agreement to be in writing and entered in the DLD's register, and the agreed fee is part of Form A or Form B. Under the bylaw, unless agreed otherwise, the broker earns the fee once the sale contract is concluded and registered. A separate commission letter with the client that differs from Form A or B is asking for trouble.
Co-broker splits and Form I
Form I was RERA's agreement between two brokers sharing a deal, setting the split and how they would cooperate. Brokerages still use it, but the DLD's November 2024 brokerage practice guide does not mention it and we found no current system step for it. In practice it is a written agreement between two licensed agencies.
That makes it a good fit for an e-signature. Each agent signs on their phone, the certificate records who signed and when, and both agencies keep the same sealed PDF. If your agency uses the RERA Form I wording, upload that PDF; otherwise use your own. Check with your RERA trainer if you are unsure what your agency must use.
Rental fee letters
On rentals, agencies commonly charge the tenant a fee, often quoted as a percentage of the annual rent. A one-page fee letter, signed by the tenant before the contract, avoids the argument at handover. Put the fee, VAT and when it is due in writing.
What to put in a co-broker agreement
Keep it short. Two agents in a car park should be able to read it before they sign.
- Both brokerages' names and ORNs, and each agent's name and BRN
- The property, with Form A contract number where there is one
- The client each side represents
- The split, as a percentage and as an amount once the price is known
- When each side is paid and what happens if the deal falls through
Questions people ask
Is RERA Form I still required in Dubai?
We could not confirm it. The DLD's 2024 brokerage practice guide does not mention Form I. Brokerages still use it as a written co-broker agreement, so ask your RERA trainer what your agency should use.
Can two agencies e-sign a commission split?
Yes. It is a private agreement between licensed brokerages and can be signed electronically under Federal Decree-Law No. 46 of 2021.
Can I pay a referral fee to someone who is not a broker?
Check RERA's rules and your trainer before agreeing any fee with an unlicensed person. A signed agreement does not make an unlawful fee lawful.
Should I sign a separate commission agreement with the seller?
The fee belongs in Form A. A second agreement with a different figure creates a conflict. Use Sign PDF for terms that Form A does not cover.
